US Entry Waivers - Overview
Over the last few years, the U.S. Department of Homeland Security
has taken measures to increase border security. With a criminal
record and without a U.S. Waiver, you
may suffer the embarrassment of being arrested, detained,
deported, and possibly having the vehicle which you have
arrived at the border with and property in it seized (even
if you are not the owner or the driver). If you must travel to the
U.S. with a criminal record, please contact

Here are the facts!
We have had Public Defenders from New York, Washington, and Michigan
call in regards to Canadian citizen clients who had been detained
in the U.S. due to crossing the border with a criminal record. All
of these clients did not posses a U.S. Entry Waiver.

If you have been stopped at the
border and refused entry you are in the Homeland Security
criminal database forever. |

If you have applied for or been granted a
Pardon from the National Parole Board of Canada you may still
need a U.S. Entry Waiver. Canadian Pardons ARE NOT recognized
by the U.S. government. |

If you have stayed within the U.S. longer
than the time allotted to you by Homeland Security you may
be detained and subject to criminal charges and be banned
from the U.S. completely for up to 1 to 10 years. You will
be detained as well while you await your hearing in the U.S. |

Of all the crimes listed in the Homeland Security
“Crime Involving Moral Turpitude” handbook only
12% are admissible into the U.S. if on a Canadian criminal record.
However if a U.S. agent feels that the crime did in fact involve
moral turpitude or violated the U.S. Health Act they have the
right and authority to refuse you entry, including DUI’s.

If you lie to a border agent about your criminal
record, regardless of the crime you had committed, the agent
then has the right to refuse you entry into the U.S. |

Do I Need A U.S. Entry Waiver ?
To be 100% sure that you will not be refused or
detained at the border, a U.S. Entry Waiver is needed. Why take
the chance of having a vacation ruined, being embarrassed on a business
trip, and loosing travel costs?
It is vital that you apply well in advance of travel
plans. It takes about 4 to 10 months for us to prepare a Waiver
application in full and approximately a further 6 to 9 months from
the time the application is submitted according to Homeland Security.
